Terms & Conditions

Same Day Delivery or Evening Express Delivery is available for selected postcodes and for standard items only (not available for large items and rural addresses).


Orders placed before 2pm NZT will be delivered the same day between 6pm and 9pm using NZ Post. Orders placed after the 2pm cut-off will be delivered the following business day between 6pm and 9pm.


If your order is not delivered as promised, we will notify you via text and email. In such cases, we will switch to our standard delivery service and refund your Evening Express Delivery fee. Standard deliveries will arrive within 1-4 working days.

We stand by the quality of our products and we make things right if you are not satisfied with your purchase. You can return any products to receive a refund of the purchase price or exchange the products within 30 working days of receipt (for any reason), provided that the products are returned in their original condition with original or appropriate packaging and invoice. 

For purchases bought in December 2024, we will extend the return window to 60 days from the original purchase date.

Entry Restrictions

Entry is open to:
• Residents of New Zealand who are aged 18 years and over;
• Who are new/existing Nespresso members;
• Who have purchased a Participating Product from a Participating Retailer during the Promotional Period; and
• Who have submitted a claim in accordance with the claim method (“Eligible Entrant”)

Participating Product(s)
Any Participating Product includes any Nespresso Vertuo coffee machine or bundle (Vertuo machine + Aeroccino3). For the avoidance of doubt, a Participating Product does not include:
a) Nespresso Business Solution machines; or
b) Commercial sales, second-hand, refurbished, trade seconds of similar products as determined by Nespresso in its sole discretion.
Participating Products are subject to availability. Availability of products may vary between channels.

Participating Retailers
A Participating Retailer includes retailers in New Zealand who sell Participating Products and which display “Be in to win an ASB Classic Tennis Experience” promotional material.
For the avoidance of doubt, the following are not Participating Retailers:
• Nespresso online at www.nespresso.com;
• Nespresso via phone 0800 234 579;
• Nespresso Boutiques; or
• The Nespresso App.

Entry Method
To enter, Eligible Entrants must during the Promotional Period:
(i) Purchase a Participating Product from a Participating Retailer during the Promotional Period (note: retain original itemised purchase receipt);
(ii) Visit the Website (www.nespressopromotion.co.nz) and follow the
prompts to the Promotion entry page;
(iii) Login or sign up to become a Nespresso member(note: entrants must ensure their Nespresso membership details are up to date (including phone number and email address);
(iv) Provide information including (but not limited to) machine serial number, machine type, place of purchase, date of purchase and upload an itemised purchase receipt which shows the Participating Retailer, Participating Product(s), receipt/invoice number and the price and date of purchase. Claims without a valid proof of purchase
will not be accepted.

The Promoter will conduct a draw from all entries received in the Promotional Period to determine a Major Prize Winner.

Maximum entries permitted
Multiple entries are permitted, however:
(1) There is a limit of one (1) entry per Eligible Purchase of a participating product; and
(2) Must be submitted separately and must independently comply with these Terms and Conditions.

Draw Details
The draw will take place at 11:00am NZDT on 20 December 2024 at the offices of the Promoter. The draw is electronic, and a winner will be selected at random. The first (1) valid entrant drawn will be deemed to be the Major Prize Winner and will be awarded with a Major Prize. Reserve Entrant(s) may also be selected during this time.

1 x Major Prize will consist of:
● Two (2) Yock Plaza tickets to the ASB Classic Men’s Final, scheduled on 11 January 2025.
● Return economy class airfares for two (2) adults from winners nearest New Zealand city (either Wellington, Napier, New Plymouth, Nelson, Christchurch, Dunedin or Queenstown) (dependent on winner’s location*) to Auckland.

Prize Winner Notification
The Major Prize Winner will be notified by either telephone or email by 5.00pm NZDT on 20 December 2024.

Prize Winner Publication Details
The initial of first name, surname and postcode of the Major Prize Winner will be published on http://www.nespresso.com/nz/en/terms-and-conditions by 20 December 2024.

Prize Claim Date and Redraw Details
Due to the time sensitive nature of the Major Prize, the Major Prize must be claimed by 11:59pm NZDT 22 December 2024, by responding to the Prize
Winner Notification. If the prize is not claimed by the Prize Claim Date, the Promoter’s may, at its discretion choose to extend the Major Prize Winner’s time to claim or elect to select a new prize winner. If the Promoter elects to select a new prize winner, the Promoter will contact a Reserve Entrant. The Reserve Entrant will be notified by telephone or email and their details will be published on http://www.nespresso.com/nz/en/terms-and-conditions by 12pm on 23 December 2024. The winner will be required to claim prize by 5pm NZDT on 24 December 2024 or the prize may be forfeited.

Conditions of Entry

1. These Conditions of Entry are to be read in conjunction with the Schedule to Conditions of Entry. To the extent that there is any inconsistency between the Conditions of Entry and the Schedule to Conditions of Entry, the Schedule to Condition of Entry prevails.

2. Information on how to enter & prizes form part of these terms & conditions. Any entry not complying with these Conditions of Entry and Schedule to Conditions of Entry is invalid.

3. Standard entry restriction: Employees of the Promoter, the Promoter’s associated companies, the Promoter’s agencies associated with the Promotion and their immediate families are ineligible to enter.

4. Promotional Period: The Promotion will take place during the Promotional Period. Any entry that occurs outside this period is invalid.

5. Receipt of entries for electronic entries: Entries are deemed to be received at the time of receipt into the Promoter’s database. The Promoter is not responsible for incorrect, inaccurate, incomplete, late, lost or misdirected information caused by an entrant or occurring during transmission.

6. Games of Chance: If more than one prize is offered for that draw, the prize with the highest value will be awarded first. If other prizes are available to be won in the Promotion, they will be awarded in descending value. The name of any prize winner will be published on the internet at

7. Verification Requirements: The Promoter may require the entrant to provide proof of identity, age, and residency and that the entrant meets all entry requirements. Where the Promotion requires the purchase of a product(s), the Promoter may require any prize winner to produce the original purchase receipt/s for
every entry they or their household made during the Promotion period in order to claim a prize. If an entry cannot be verified to the Promoter’s satisfaction, the entry will be invalid.

8. Monetary Prizes: If money is offered as a prize, the prize may be awarded by way of cheque, EFTPOS card or by transfer to a nominated bank account. If the prize is to be delivered by bank transfer, the winner will be required to advise the Promoter of their nominated bank account details for their prize money to be deposited.

9. Tickets to an Event or an Experience: If tickets to an event or an experience are offered as a prize, the prize will be subject to the organiser’s terms. To the extent permitted at law, the Promoter is not liable for any cancellation or re-scheduling that may prevent prize fulfilment. The tickets to the event cannot be converted to cash nor replaced if lost, stolen or defaced. Tickets can only be used on the date(s) specified on the ticket.

10. Trip Prize: If travel is offered as a prize, flights and accommodation are subject to availability at time of booking. Additional spending money, meals, taxes, valid passports, visas, transport to & from departure point additional transfers, insurance & all other ancillary costs not specifically stated in the Schedule to Conditions of Entry are the responsibility of the winner. It is a condition of accepting the prize that all components of the prize be taken during the trip and all persons taking the trip depart from & return to the winner's nearest capital city at the same time unless otherwise agreed by the Promoter.

11. Vouchers: If a voucher is offered as a prize, the prize will be subject to the issuer’s terms of use and are valid until the voucher expiry date stated on the voucher itself. The card cannot be converted to cash nor replaced if lost, stolen or defaced.

12. Vehicle: If a vehicle is offered as a prize, the vehicle includes registration, 3rd party insurance, a full tank of petrol and all on-road costs. Any additional costs including comprehensive insurance and additional optional extras are the responsibility of the winner.

13. Standard Prize Restriction: All prizes unless stated to the contrary are not transferable & cannot be converted to cash.

14. Prize Value: Prize value is correct at time of printing, but no responsibility is accepted for any variation in the value of any prize.

15. Prize Delivery: Prizes will only be delivered in New Zealand and each winner should allow 28 days from prize winner determination for delivery of their prize, or (if required) the date they advise the Promoter of their nominated NZ bank account details for their prize money to be deposited.

16. If a prize winner or participant is under the age of 18 years of age: The prize will be awarded to the winner's parent/guardian on their behalf. The Promoter may require a winner under the age of 18 years be accompanied by their parent or legal guardian throughout prize fulfilment.

17. If the prize becomes unavailable: The Promoter may substitute a different prize item of equal or greater value in the event that any prize item is unavailable despite the Promoter’s reasonable endeavours to procure within New Zealand. This substitution may be subject to any approval process required by any relevant gaming or lotteries authority if the Promotion is a game of chance.

18. Tampering: The Promoter may disqualify any individual entrant or group of entrants for tampering with the entry process. Tampering includes but is not limited to the utilisation of techniques designed to avoid payment of call costs or the making of multiple entries that are not associated with a separate eligible purchase, or submitting an entry which is not otherwise in accordance with these Conditions of Entry and Schedule to Conditions of Entry. Should the Promoter find evidence of tampering by an individual, in addition to declaring any or all entries made by that individual invalid, the Promoter may also preclude that entrant from participation in future promotions of the Promoter.

19. Technical Malfunction: If for any reason this Promotion is not capable of running as planned, whether caused by computer virus, mobile phone failure, line drop out, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness or integrity of the Promotion, the Promoter may (subject to any written direction given by a relevant Regulatory Authority), cancel, terminate, modify or suspend the Promotion. The Promoter is not responsible for any problems or technical malfunction of any telephone, telephone or computer network, or lines, servers, or telephone or internet providers, traffic congestion on any phone or computer network, or any combination thereof, related to participation or sending or receiving of any communication or of any materials in this Promotion.

20. Publicity: If a winner agrees to participate in follow-up interviews and publicity then the Promoter may use their name, image, photograph/s, film and sound recordings for publicity and promotion purposes, without compensation, and the Promoter will own copyright in any such images, photograph/s, film and sound recordings and in all material incorporating the same.

21. Entry Content: The Promoter may adapt and use any entry content for publicity and promotion purposes for an unlimited time throughout the world without compensation in any media, social media, advertising and/or promoting any goods or services of the Promoter.

22. Copyright: It is a condition of participating in the Promotion that the entrant warrants that their entry is original and does not infringe the intellectual property of any third parties. The entrant assigns all rights, title and interest in their entry to the Promoter without compensation. The entrant further agrees not to object to the Promoters use of the entry material on the basis of any moral right. The Promoter may, if required request that an entrant complete any documentation necessary to give effect to this assignment of right, title and interest.

23. Liability: To the extent permitted by law: (a) the Promoter’s only liability is as expressly stated in these terms and provisions in the New Zealand Consumer Guarantee that cannot be excluded, and all other guarantees, warranties and conditions are excluded; and (b) the Promoter will not be liable to you
(whether in contract, tort or otherwise) for any consequential, special, incidental or indirect loss or damage including loss of profit or loss of opportunity. 

24. Consumer Guarantee: Each prize winner should look to the manufacturer of products and provider of services awarded as prizes for all warranties. However, these terms and conditions do not exclude or limit the application of any statutory provision (including a provision of the Consumer Guarantees Act 1993 [NZ] where to do so would contravene that statute or cause any part of these terms and conditions to be void.

25. Disruptive, abusive, unsuitable entries: The Promoter may determine all entries invalid and/or preclude participation by an entrant if an entrant disrupts, annoys, abuses, acts contrary to law or engages in fraudulent or misleading and deceptive conduct.

26. Tax: Winners should obtain their own independent financial advice in relation to any tax liability that may arise as a result of their participation in the Promotion.

27. Promoter’s Decisions: All decisions are at the discretion of the Promoter (acting reasonably) and are final. No correspondence will be entered into.

28. Social Media: The Promotion is in no way sponsored, endorsed or administered by or associated with Facebook, Instagram or Twitter. Entrants completely release Facebook, Instagram or X (formerly known as Twitter) from any and all liability relating to the Promotion (this release is a requirement of the operators of Facebook, Instagram and X (formerly known as Twitter)).

Nespresso – Consumer Offer Terms and Conditions

Update of terms and conditions 24/09/24:

These terms and conditions have been updated, the changes are as follows:

  1. Update of Offer 3 Participating Products, to include three additional machines (which must be purchased between 24 September 2024 to end of the Promotional Period to avail of the Offer).
  2. Update of the General Claim Conditions to clarify that these Offers may be combined with promotions offered by retailers (unless otherwise specified by the retailer).

  • Nespresso via phone 0800 234 579;
  • Nespresso Boutiques;
  • The Nespresso App;
  • The official Nespresso eBay store; or
  • Costco.

    • Discount of $25 per order, on twelve (12) orders (minimum of each individual order is $80); and

Nespresso discounts used to purchase Nespresso capsules, machines or accessories from Nespresso Boutiques, by calling the Nespresso Club on 0800 234 579, by visiting the Nespresso website or through Nespresso mobile app. The above-mentioned minimum spend applies for each order, to claim the submit their Claim by 11:59pm (NZDT) on 9th March 2025.


Claim Method

To claim, Eligible Claimants must:

  1. Purchase a Participating Product from a Participating Retailer during the Promotional Period (note: retain original itemised purchase receipt);
  2. Visit the Website https://nespressopromotion.com.au/machine-registration/intro by 11:59pm (NZDT) on 9th March 2025;
  3. Login or sign up to become a Nespresso Member;
  4. Complete claim form and upload an itemised purchase receipt which shows the Participating Retailer, Participating Product(s), receipt/invoice number and the price and date of purchase. Claims without a valid proof of purchase will not be accepted.

Nespresso will contact Eligible Claimants by email within 10 business days, to advise of the outcome of their Claim. Once approved, the Nespresso discount will be applied to the Eligible Claimant’s Nespresso account and can be used towards coffee capsule, accessory or machine purchases online at https://www.nespresso.com/nz/en, by phoning Nespresso on 0800 234 579, by visiting a Nespresso boutique or via the Nespresso App.

Please note: Orders which utilise a Nespresso discount must meet the Nespresso Discount Conditions stated below.


General Claim Conditions

This offer is subject to stock availability within the applicable channel. If stocks run out or are unavailable, Nespresso reserves the right in its sole discretion to end the promotion. If stocks of the Gift run out or unavailable, Nespresso may provide an alternate gift of equal or higher value. Offers may be combined with other Nespresso promotions offered by specific retailers during the promotional period (unless otherwise specified). The following conditions apply when using your Nespresso® discount:

  • Once your claim is approved, the Nespresso discount will be added to your Nespresso account.

How to use your Nespresso discount:

  1. Simply place an order $50+ (for Offer 1); $80 (for Offer 2); or $120+ (for Offer 3) on coffee capsules, accessories or machines from https://www.nespresso.com/nz/en, by phoning Nespresso on 0800 234 579, by visiting a Nespresso boutique or via the Nespresso App;
  2. Provide your Nespresso details at checkout;
  3. Your discount of $15 (for Offer 1) or $25 (for Offer 2) or $35 (for Offer 3) will automatically apply at checkout. Plus, a free Touch Travel Mug (“Gift”) will be added to your first order.

Nespresso discounts are provided in instalments over twelve (12) orders and cannot be combined as a lump sum discount. Nespresso discounts are valid for two (2) years. The discounts are not transferable and cannot be redeemed for cash. Other Conditions

The Offer is available to New Zealand residents aged 18 years and over who provide a New Zealand

employee’s immediate families are ineligible to claim this offer.

  1. Use with other offers: This Offer is not available in conjunction with any other Nespresso promotion, offer or discount. This Offer is not available at Costco (Costco is not a Participating Retailer). The Offer is not valid for commercial sales, second-hand, refurbished, trade seconds or similar products. The Offer does not apply to Nespresso Professional (also known as Nespresso Business Solution) machines or capsules.
  2. Verification: Nespresso has the right to verify the validity of all claims and may disqualify any individual claimant or group of claimants for tampering with the claim process. Proof of purchase documentation (in the form of a purchase receipt) must clearly show the Participating Retailer, the Participating Product, the price paid and the date of the purchase. The serial number of the machine must also be provided to Nespresso. Claim details that are ineligible or incomplete will be considered void.
  3. Returns: Nespresso reserves the right to refuse any claim if the Participating Product is returned to the point of purchase.

1.These Terms and Conditions (Terms) apply to this Promotion and, by entering this Promotion, you represent that you are eligible to enter and agree to be bound by these Terms.

Promotional period

3. The Promotion will be open from 12:00am New Zealand Standard Time 01/11/2024 and will close on 11:59pm New Zealand Standard Time on 31/12/2024 (Promotion Period).

10. The following are not Participating Products for the purposes of this Promotion:

a) any Participating Product that has not been paid for in full by the Eligible Claimant within the Promotion Period;

b) any Participating Product that is already on promotion, discounted, or otherwise forms part of a special offer from the Participating Retailer (including staff discounts for staff of Participating Retailers);

12. Eligible Claimants must retain their original Participating Retailer purchase receipt or electronic receipt as proof of purchase. Failure to produce the proof of purchase when requested by the Promoter may, in the discretion of the Promoter (acting reasonably), result in invalidation of the Eligible Claimant’s Bonus Offer Claim and forfeiture of any right to the Bonus Offer.

13. An Eligible Claimant may only make one (1) Bonus Offer Claim in respect of each Participating Product purchased from a Participating Retailer during the Promotion Period. If an Eligible Claimant purchases multiple Participating Products and wishes to make a Bonus Offer Claim for each of those purchases, then each Bonus Offer Claim must be submitted separately and in accordance with these Terms.

14. Bonus Offer Claims will be deemed to have been made at the time of their receipt by the Promoter and not at the time they are submitted.

15. Eligible Claimants may only make a Bonus Offer Claim in their own name and using their own personal details.

16. A person must not make a Bonus Offer Claim to which another Eligible Claimant is entitled, whether on their behalf or otherwise. If there is a dispute as to the identity of an Eligible Claimant, the Eligible

When is a Bonus Offer Claim invalid?

18. Any Bonus Offer Claim that fails to comply with these Terms will be invalid.

19. Bonus Offer Claims that are incomplete, incorrect or incomprehensible, or if they are stolen, forged, damaged or tampered with in any way.

20. A Bonus Offer Claim made with the use of automatic software or similar devices (for example, if automatic software is used to enter details into the Promotional Website) will be invalid.

21. The Promoter may decline any invalid Bonus Offer Claim, although it reserves the right (in its discretion, acting reasonably) to contact (or attempt to contact) the individual who made the invalid Bonus Offer Claim to attempt to resolve any issues with their invalid Bonus Offer Claim that are capable of resolution. If, following contact with the relevant individual, such issues are resolved by that individual to the satisfaction of the Promoter, the Promoter may accept the updated Bonus Offer Claim as a valid Bonus Offer Claim.

22. The Promoter’s decision on the validity of a Bonus Offer Claim is final and no correspondence will be entered into.

What happens once a Bonus Offer Claim is made?

23. Once the Promoter has determined that the Bonus Offer Claim is valid, the Promoter will (at its cost) dispatch the Bonus Offer to the address provided by the Eligible Claimant (which must be a New Zealand address) within 12 weeks from the date that the Promoter determine the Bonus Offer Claim to be valid.

24. If the Bonus Offer, or a component of the Bonus Offer, is unavailable or out of stock, the Promoter, in its discretion (acting reasonably), may substitute the Bonus Offer, or component of the Bonus Offer, with a gift of equal or greater value and/or specification.

25. Each Bonus Offer is not transferable or exchangeable and cannot be redeemed for cash.

26. All other costs incurred by the Eligible Claimant in relation to the Bonus Offer, such as accessing the internet or making telephone enquiries in relation to the Bonus Offer, are the responsibility of the Eligible Claimant.

27. The Promoter will make reasonable efforts to deliver the Bonus Offer(s) to Eligible Claimant(s). The Eligible Claimant shall accept the Bonus Offer as described in these Terms and acknowledges that the Promoter accepts no responsibility for any variation in the value of the Bonus Offer made pursuant to clause 24.

An order made via this site ("order") is an offer to purchase one or more products. When we receive a valid order from you, we will accept this offer by confirming via email that we have received and are processing the order.

We will deliver the products set out in your order ("products") almost anywhere in New Zealand. We do not deliver outside New Zealand, however, an overseas order may still be placed with a NewZealand delivery address. Delivery is made by courier.

We endeavour to deliver all products within 3-5 working days of us confirming receipt of the order, although this timeframe is an estimate only. If we are not able to supply the products or there is likely to be a significant delay in making delivery (e.g. because the product is out of stock or the delivery is to a rural/remote location*), we will notify you as soon as reasonably possible after we become aware of this, in which case you may cancel the order (or any part of it) and you will receive a refund (including the applicable delivery charges) in respect of those products which will not be delivered (if any). We will not otherwise be liable to you for any damages, costs or expenses of any kind, suffered or incurred by you due to the order not being fulfilled or the products not being delivered within the anticipated delivery time.

The anticipated delivery charges (if applicable) will be notified to you when you complete the order, although in some cases the actual delivery charges may be higher (e.g. if the products are large/heavy or delivery is to a rural/remote location). We will notify you if the actual delivery charges are higher than those anticipated, in which case you may cancel the order (or any part of it) prior to delivery and receive a refund (including the applicable delivery charges) in respect of the cancelled order.

The delivery charge is $7, with some exceptions*.

* For large/heavy items, the delivery charge is $75. We are unable to deliver large items on weekends. Please also note that deliveries to the Outer Islands (Chatham Island, Stewart Island, Kawau Island, Waiheke Island, Matakana Island, Great Barrier Island and d’Urville Island) will incur additional costs.

Please provide a physical delivery address to allow our courier to deliver to you. We cannot deliver to P.O. Boxes. If for any reason there is an issue with your order we will contact you to provide and update and alternative options.

All Briscoe Group freight being delivered by Aramex Couriers should be attempted to be personally delivered to the recipient with a signature obtained in accordance with the Fastway Couriers standard policy. 

In a situation where a signature cannot be obtained the Aramex authorised driver has been given authority to leave the parcel where practical, unless a signature has specifically been requested. Any special delivery instructions provided on the label will be followed (ie. Leave in letterbox or at back door).

The products will comply, in all material respects, with their product descriptions appearing on this site at the time when you submit the order. If a product does not comply with its product description, you may return the product(s) and accept a refund or exchange the product(s) - for more information please see our Returns page.

The risk of any loss of, or damage to, the products will pass to you on delivery.

The prices for the products listed on this site are in New Zealand dollars and include GST, but not any delivery charges. Briscoes Gift cards and eGift cards expire 24 months from the date of issue. Any unspent value cannot be used or redeemed after the date of expiry
Gift cards and eGift cards are non-refundable and cannot be exchanged for cash. No change will be given. Any gift card can be redeemed in whole or for part of a payment. Unredeemed values will remain on the gift card. After a Briscoes gift card has been activated, you cannot subsequently add value to it. Once your Briscoes gift card has reached a nil balance it cannot be re-activated.
